§ 110.01. LICENSE REQUIRED; EXCEPTIONS.

  • (A) No person shall hold or conduct any auction sale within the city without first procuring a license to do so.

    (B) Nothing in this chapter shall be construed to prevent any person from disposing of the goods, wares and merchandise of a business at auction sale if the person has been engaged in the retail or wholesale business continuously for a period of one year in the city immediately preceding the auction sales; provided, however, that such a person shall be entitled to hold an auction sale without license to do so only for a period of one week out of any year. After an auction sale has been conducted for one week or any part of the week by the person, all subsequent auction sales during that year must be licensed according to division (A) above. Nothing in this chapter shall be construed to prevent any person from selling any and all goods, wares or merchandise which are to be sold either at public auction or private sale, by virtue of any lawful order of any court having jurisdiction of the subject matter of the sale.
